The Berger Lawsuits
In a January 8th article entitled "Hospitals' ill-fated fight for life," Crain's New York Business notes that six lawsuits have been filed by hospitals the Berger Commission slated for closing. Although the NY State Department of Health is already working out the details of hospital closings (and the Berger commission director says he anticipated various lawsuits), the hospitals that have sued are hoping for a reprieve, arguing that they were denied their rights to due process without a hearing before the Health Department. In Forest Hills, Queens, Parkway Hospital is even asserting that the State cannot revoke their operating license while they are in the midst of bankruptcy proceedings.
